Conditions
OF HIRE
1. Parties
(a) The Hirer is UPSET Paris, located in 66 Avenue Secretan, 75019 Paris. (b) The Hiree refers to the individual or business named on the purchase order or rental agreement.
2. Official Order
All transactions with UPSET Paris must be conducted using the Hiree's order form, which should include the agreed items and hire charges for a weekly period. The official order must contain the registered business address and VAT number.
3. Hire Charges
The hire charges are as follows:
1st week: 20% of the quoted value of the item
Longer hires can be arranged through special agreement.
4. Extended Hire
The Hiree cannot extend the hire period without obtaining written agreement from UPSET Paris at least 48 hours prior to the original return date.
5.Payment and Credit term
Payment for all services is due at the time of hire or at the time of notice in the case of an extension, unless the Hiree has an account with UPSET Paris. For account customers, payment is due within 30 days from the date of the order. We accept payment only by bank transfer. UPSET Paris reserves the right to request a deposit against any order(s) placed with us. A minimum Charge of € 150,00 + Vat is requested for each order.
6. Loss/Damage and Insurance
During the hire period, the Hiree agrees to keep the items in good repair and condition. If items are returned damaged or altered, UPSET Paris will restore them and charge the cost of restoration, including depreciation if applicable. Items that cannot be restored or are not returned will be charged at their insurance risk value as specified in the hire agreement. It is the responsibility of the Hiree to obtain insurance coverage from reputable Italian insurers. The insurance should cover the risk values against loss or damage from the time of collection until return. The Hiree may be required to provide a certificate of insurance upon request. Any discrepancies regarding the items must be reported within 24 hours from collection.
7. Collection and Delivery
The Hiree is responsible for both the collection and return of the goods.
UPSET Paris can arrange transport on request and is not included in the hire charge.
UPSET Paris reserves the right to refuse loading a job if the client has provided unsuitable transport. It is responsibility off the Customer to ensure any sub-contracted transport has adequate insurance cover. Appropriate blankets and ties should be used in enclosed vehicles for transportation.
Packing crates, which are supplied free of charge for the period of hire, will be charged to the Customer if not returned.
8. Preservation and Safety
No alterations can be made to the items without prior written consent from UPSET Paris. If permission is granted for alterations, it will be subject to limited conditions specified in writing. The Hiree must inform UPSET Paris of the location of the items upon request. The hired items should only be used for their intended purpose and must not be lent or sub-hired to any third party. The responsibility for the safe use of the items rests with the customer and we highly recommend that all are checked prior to use. Electrical items are supplied as props and not for use as originally intended.
9. Item care and instructions
Here are the instructions for handling and care of the items
All items should be lifted instead of dragged. For heavy items, it is recommended to have two or more people for safe handling.
Upholstered items that are prone to marking, such as velvet and leather, should be carried by the base only.
Furniture should not be dismantled unless prior agreement has been made. Clients are responsible for ensuring that the location is easily accessible before hiring.
Art fixings should not be removed or altered. Avoid removing glass or pictures from frames to prevent additional reframing charges. Large art pieces should be handled by two people
Beds are sent in a dismantled state. Please contact us for any assembly instructions.
Furniture with glass surfaces will be packed separately. Handle with care and avoid placing heavy objects on or against the glass.
Headboards are not freestanding and must be supported from behind. They should not be fixed onto beds or other surfaces.
Lacquer and marble items are sent with heavy-duty bubble wrap to protect their glossy finish. Take extra care to protect the edges and surfaces at all times. We recommend keeping lacquer items protected until they are placed in their intended position.
Certain wall mirrors cannot be hung and should only be leaned against stable surfaces. This information will be highlighted in the item description.
Pendant lamps are sent without plugs and are not PAT tested. They will need to be wired at the location.
Lamps should always be carried by the base and the pole.
Lampshades should be returned in the original box and should not be stacked inside one another.
Unless specified in the item description, lightbulbs will not be included with lamps.
Rugs and upholstery should be protected from heavy items and foot traffic to prevent lasting damage to the fabric. Any damage or dirt beyond normal domestic use will incur a professional cleaning charge.
For wood and painted surfaces, avoid direct contact with water and hot items. Do not apply adhesive tape directly to the surfaces for labeling purposes.
Some items may be sent in parts and will require assembly, such as shelving units, cupboards, beds, and divans.
Please reuse and return the packaging to avoid any replacement charges.
Please ensure that these instructions are followed to maintain the condition of the items and prevent any additional charges.
10. Indemnity, Limitation of Liability and Copyright
The Hiree shall indemnify UPSET Paris against all claims, expenses, and legal costs arising directly or indirectly from the use or condition of the items. UPSET Paris does not provide any warranty of fitness for purpose. The Hiree is advised to comply with copyright legislation and ensure that all necessary clearances, permissions, or releases have been obtained before using any item. UPSET Paris shall not be held liable for any complaints or claims of infringement of copyright or other rights. UPSET Paris is unable to give general copyright clearance on our goods as not able to control over how the items are used. If you have any doubts or concerns please seek your own legal advice.
11. Law
All parties agree that French law shall govern this agreement, and they submit to the exclusive jurisdiction of the French Courts.
By placing an order with UPSET PARIS you accept that
(a) You have read and accept our terms and conditions printed above.
(b) Our terms and conditions will prevail at all times.
(c) You will make payment of all invoices according to our credit terms.
